Welcome to PCRADIO, your source of streaming radio through our website at pcradio.app and our specialized mobile applications for iOS and Android platforms. By using our services, you agree to these Terms of Use (hereinafter "Terms"). Please read them carefully.

1. Acceptance of Terms

By using the PCRADIO website or mobile applications, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree with any part of these Terms, you should not use our services.

2. Changes to Terms

PCRADIO reserves the right to modify these Terms at any time. We will post the revised Terms on our website and update the "Last Updated" date to reflect the changes. Your continued use of our services following the posting of such changes constitutes your acceptance of the new Terms.

3. Use of Our Services

PCRADIO grants you a limited, non-exclusive, non-transferable, and revocable license to use our services for personal, non-commercial purposes, in accordance with these Terms.

By using the PCRADIO site and applications, users should be aware that the service includes the display of advertising, and we are not responsible for the content of this advertising. Users should understand that advertising providers may collect and use certain user data, including, but not limited to, approximate location, device identifiers on which the application is installed, data on crashes, errors, etc., for the purpose of providing relevant advertising and improving the quality of their services.

We make efforts to ensure that advertising complies with high standards of quality and relevance, however, the ultimate responsibility for the content of the advertisements lies with the advertisers. We recommend that users familiarize themselves with the privacy policies of advertising providers to better understand how and for what purposes their data is collected and used.

4. User Conduct

You agree not to use our services in a way that:

• Violates any local, national, or international law or regulation.
• Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, indecent, or otherwise objectionable.
• Interferes with or disrupts our services.
• Attempts to gain unauthorized access to our services, user accounts, or our network or computer systems.

4.1 Responsibility for Comments

The PCRADIO service is not responsible for the content of comments left by users on the site. We cannot be aware of all instances when a comment may infringe someone's rights, and, although comments are moderated, this does not exclude the possibility of errors in moderation. The responsibility for comments and any potential violations related to their content lies entirely with the user who posted the comment. We urge users to show respect and adhere to standards of decency when interacting in comments, as well as to consider the rights and feelings of others.

5. Intellectual Property Rights

All rights, titles, and interests in and to PCRADIO services (excluding content provided by users) are and shall remain the exclusive property of PCRADIO and its licensors. Nothing in these Terms grants you the right to use the PCRADIO name or any of the trade marks, logos, domain names, and other distinctive brand features of PCRADIO. Furthermore, all trademarks, logos, station descriptions, and broadcast content presented in our services are the property of their respective company and trademark owners. Content posted on our site and in our applications belongs to its lawful owners and is protected by applicable intellectual property laws.

We respect the intellectual property of others and expect that users of our services will also respect these rights. Content posted on the PCRADIO site and applications, including information about radio stations, their logos, and audio content, is provided exclusively for personal non-commercial use. Content owners are responsible for the authenticity of licenses, permissions, and rights to distribute content. PCRADIO is not responsible for any infringement of third-party rights resulting from user’s use of the provided content.

Content, including radio stations, logos, stream links, and station descriptions, may be added by users through a specialized form on the site and through the contact form. This allows users to contribute to the diversity of content available on PCRADIO, however, it is important to note that all information provided by users must comply with applicable intellectual property laws and third-party rights. The service reserves the right to review and remove content without prior notice and explanation in case of rights violations, unauthorized use, lack of coordination with trademark and content owners, as well as at the request of courts or law enforcement agencies.

5.1 Adding Online Radio Station Data to the PCRADIO Site and Applications

By adding a radio station to the site through a form or email message, the owner grants PCRADIO a temporary, non-exclusive license to use, distribute, and re-broadcast via the Internet - the name of the station (brand), logo (trademark), description, and streaming broadcast stream on the PCRADIO site (pcradio.app) and in the PCRADIO applications for iOS and Android operating systems, which he may revoke at any time by removing the station from the service upon request. This includes the right of PCRADIO to public performance, re-broadcast, access, and distribution of the content (logo, description, link to the streaming broadcast stream) of the station as part of the service. The station owner guarantees and agrees that they have all necessary rights and permissions to grant such a license and that the station content does not violate third-party rights, including copyright, trademarks, and privacy rights.

Although the PCRADIO service has licensing agreements with the Russian Author's Society (RAO) and the All-Russian Organization of Intellectual Property (VOIS), this does not relieve radio station owners of the obligation to conclude similar contracts and pay copyright royalties in accordance with current legislation. Station owners are fully responsible for complying with copyright requirements and related payments.

6. Termination

PCRADIO may immediately terminate or suspend your access to our services without prior notice or liability for any reason, including, but not limited to, violation of the Terms.

7. Disclaimer of Warranties

Our services are provided on an "AS IS" and "AS AVAILABLE" basis. PCRADIO makes no representations or warranties of any kind, express or implied, as to the operation of our services or the information, content, or materials included in our services. This includes, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular, we are not liable for any damage, direct or indirect, that may arise as a result of the cessation of broadcasting stations in our applications and on the site. By hosting a radio station in the PCRADIO service, we do not guarantee its uninterrupted operation and broadcasting. Our goal is to enhance the radio listening experience with optimized streams as a convenience for users of the PCRADIO site and application, but this does not entail a guarantee of uninterrupted or unchanging services.

Users must acknowledge that technologies and internet connections can have interruptions and that PCRADIO cannot guarantee that access to its services will not be interrupted or that data transmission will always be error-free.

8. Limitation of Liability

To the maximum extent permitted by law, PCRADIO is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use our services.

9. Subscription Purchases

PCRADIO offers subscriptions for 1 month and 1 year, which provide access to additional features and content in our applications for iOS and Android. Subscriptions are automatically renewed until cancelled.

9.1 Subscription Purchase

Subscriptions are available for purchase within the applications. Prices and terms will be specified at the time of purchase. Subscription payment will be made through your account in the corresponding app store (Apple App Store or Google Play Store) at the time of purchase confirmation.

9.2 Automatic Renewal

Subscriptions automatically renew for the same period as the original subscription unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. The renewal charge will be made to your card within 24 hours before the end of the current period. You can manage subscriptions and turn off auto-renewal in your account settings after purchase.

9.3 Subscription Cancellation

To cancel a subscription, you must do so through your account in the app store. Cancelling a subscription does not result in a refund for the current subscription period, and you will continue to have access to the subscription until the end of the paid period.

Cancelling Subscription in Apple App Store:

1. Open settings on your iOS device.
2. Tap on your name, then select "Subscriptions".
3. Find the PCRADIO subscription and tap on it.
4. Select "Cancel Subscription" and confirm your action.

Cancelling Subscription in Google Play:

1. Open the Google Play app on your Android device.
2. Tap on the menu icon (three horizontal lines) and select "Subscriptions".
3. Find the PCRADIO subscription and tap on it.
4. Select "Cancel Subscription" and follow the instructions to complete the process.

After cancelling a subscription, access to paid features will be restricted after the current paid subscription period expires. If you have any questions regarding subscription cancellation or need further assistance, please contact support through the contact form on our website.

10. Applicable Law

These Terms are governed by the laws of the jurisdiction in which PCRADIO operates, without regard to its conflict of law provisions.
